There are undoubtedly benefits in taking control of the management of your building whether it be by claiming your right to manage, or by purchasing the freehold.

The Right to Manage legislation gives the leaseholders of flats the ability to collectively take over the management of the block from the freeholder.

The freeholder does not need to have been at fault in any way and the Right to Manage can be claimed by the leaseholders of most blocks, but there are eligibility criteria which must be met.

The Right to Manage gives more control to the leaseholders, including the right to appoint a new managing agent, but more responsibility comes with it too.

Enfranchisement is the legal term used when the leaseholders collectively purchase the freehold of a building which will transfer to a new company of which the participating leaseholders will be shareholders.

It is important to note that each flat owner will still have a lease and be bound by the same obligations, but enfranchisement will give the new company full control over the management of the building as well as the ability to lengthen leases and eliminate ground rent charges.
